Furthermore, Hold professional attitudes, knowledge, and skills through medical or dental professional education requiring authority to perform Health Efforts.
Position in the Law
Article 197 divides health human resources into Medical Personnel, Health Personnel, and health support personnel. Under Article 198, Medical Personnel comprise physicians and dentists across three tiers: general physician (or dentist), specialist, and subspecialist. Nurses, midwives, pharmacists, and other allied professions are classified separately under Health Personnel (Tenaga Kesehatan, Article 199).
Why the Distinction Matters
Minimum education requirements differ: Medical Personnel require at least professional education, whereas Health Personnel require at least a three-year diploma (Article 210). Practicing Medical Personnel must hold a Registration Certificate (STR, Article 260(1)) and a Practice License (SIP) issued by the regency/city government (Article 263(1)–(3)). Certain statutory powers apply exclusively to Medical Personnel—for example, narcotic. Furthermore, Psychotropic medicines may only be used based on a prescription from Medical Personnel (Article 139(2)). While other provisions name both groups, such as advanced health services (Article 37(2)).
Related terms: Health Personnel (Article 199), Council (Article 1(25)), STR (Article 1(28)), and SIP (Article 1(29)).
Legal basis: Law Number 17 of 2023 Articles 1(6), 1(25), 1(28), 1(29), 37(2), 139(2), 197–199, 210, 260(1), and 263(1)–(3). PP Number 28 of 2024 Article 1(47).
