What does Permenkes 29/2022 regulate regarding mental health examinations for specific jobs or positions?

Permenkes 29/2022 governs mental health examinations for candidates and holders of specific statutory jobs, requiring a psychiatrist.

Permenkes 29/2022 provides guidelines for mental health examinations for individuals entering, holding, or leaving specific jobs or positions. It does not apply to all workers indiscriminately. Instead, covered positions are determined by statutory regulations (Article 3(2)). The regulation sets requirements for examining facilities, examination teams, assessment scope, examinee consent, and the certificate delivered to the requester.

Who is examined and when

Every candidate for a covered job or position must undergo a mental health examination during selection or pre-placement (Article 3(1), Article 4). The Annex and PP 28/2024 Article 172(4) list job criteria. These include public officials making high-stakes decisions, jobs that could endanger oneself or others, and jobs interacting with vulnerable groups. During employment, periodic examinations may be conducted based on employer capacity or when potential psychopathology arises (Article 5(2)–(4)). Post-employment examinations may also be requested by the worker or family if potential psychopathology is identified after service ends (Article 5(5)–(6)).

Who conducts the examination and what is assessed

Examinations take place at a main clinic (klinik utama), general hospital, or mental hospital. The facility must have an Examination Team, administrative staff, a standard examination room, and professional-organization-recommended psychometric instruments (Article 8). The team must include at least two professionals: a psychiatrist and a clinical psychologist (Article 10(2)).

A comprehensive examination covers intelligence profile, personality profile, potential psychopathology, and other specific potentials. Needs-based examinations cover at least potential psychopathology alongside intelligence and/or personality profiles (Article 11), using structured psychiatric and psychological interviews (Article 13).

Consent, requests, and delivered results

The examination proceeds only if the examinee gives written consent covering both the assessment and the delivery of results to the requester (Article 12(2)). Requests are submitted in writing to the hospital director or main clinic head at the requester's expense (Article 14(1), (2), and (4)).

With examinee consent, the requester receives a certificate signed by the Examination Team chair. At a minimum, it states the presence or absence of significant potential psychopathology plus intelligence and/or personality profile results (Article 16(1), (2), and (4)). While Permenkes 29/2022 was issued under Law 18/2014 (repealed by UU 17/2023 Article 454(g)). It remains valid under UU 17/2023 Article 453(f) alongside UU 17/2023 Article 84 and PP 28/2024 Article 172.
